These Terms of Service (“Terms”) govern your use of the Bitania instant swap service (the “Service”), operated by Bitania Exchange Inc (“Bitania”, “we”, “us”). By requesting a swap, sending a deposit, or using our website or API, you agree to these Terms. If you do not agree, do not use the Service.
Our commitments to you
- No accounts, no KYC. A swap needs nothing but a destination address. We do not ask for your identity and never will as a condition of swapping.
- Non-custodial. We hold your coins only for the moments it takes to complete the swap you asked for. There are no balances to keep with us.
- What you see is what you get. The amount shown before you confirm is the amount we send. We pay the network fee of the payout ourselves.
- No surveillance. We collect the minimum needed to run a swap and keep it only as long as the swap and any support request need it.
1. The Service
Bitania exchanges one cryptocurrency for another. You send a deposit of the coin you chose to a deposit address we generate for your swap; once the deposit has the required number of confirmations we send the other coin to the destination address you gave us. Bitania is the counterparty to every swap and pays out from its own liquidity. The supported coins, their minimums, maximums and the number of confirmations we wait for are shown on the site before you confirm and can change at any time.
2. Eligibility and legal use
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and have the legal capacity to enter into these Terms. You are responsible for making sure that using the Service is legal where you are. The Service may not be used by anyone located in, ordinarily resident in, or acting on behalf of a person in a country or territory under comprehensive sanctions or embargoes, currently including Cuba, North Korea (DPRK), Syria, and the Crimea, Donetsk and Luhansk regions of Ukraine, or by anyone with whom dealings are prohibited under applicable sanctions laws. You may not use the Service to launder the proceeds of crime, to evade sanctions, or for any other unlawful purpose. We may refuse, cancel or refund a swap that we reasonably believe breaks this section.
3. Quotes, rates and the payment window
Every swap starts with a quote. You choose one of two rate types:
- Floating rate. The amount shown is an estimate. Your deposit is converted at the market rate of the moment it reaches the required confirmations, so the final amount may be higher or lower than the estimate. Any additional deposit sent to the same address while the swap is open is converted the same way.
- Fixed rate. The rate is locked when the swap is created and honoured as long as your deposit arrives within the payment window and matches the quoted amount within the tolerance shown. A deposit outside that tolerance is not executed blindly: we show you a new quote on the swap status page, and you can accept it or ask for a refund.
Each swap has a payment window, shown as a countdown on the status page. A swap that receives no deposit before the window closes expires; nothing was received, so nothing is owed by either side. A deposit that we have seen on the network before the window closes is honoured even if it confirms later. Rates come from public market data and are not investment advice.
4. Fees
Our service fee is a percentage of the swap, different for floating and fixed rates, and is displayed before you confirm; the quoted amount already has it taken off. We pay the on-chain network fee of the payout. You pay the network fee of your own deposit transaction. When a deposit is refunded, a refund fee (shown on the site) is withheld from the refunded amount and we pay the network fee of the refund. There are no other charges.
5. Your responsibilities
- Send the correct coin on the correct network to the deposit address, and give a correct destination address on the correct network. Coins sent to a wrong network, a wrong asset, or a mistyped address can be unrecoverable, and Bitania cannot restore them.
- Give a refund address when you create the swap, so that a refund can be paid automatically if the swap cannot complete.
- Keep your swap ID. It is the only reference to your swap and the only way support can help you.
- Do not attempt to interfere with the Service, probe it for weaknesses, or use it in a way that harms other users or Bitania.
6. Refunds and swaps that cannot complete
If a swap cannot be completed, because the deposit did not match a fixed-rate order and you chose a refund, because we no longer have enough liquidity for the payout, or because we had to refuse the swap under section 2, we return the deposit to your refund address minus the refund fee. If you gave no refund address, contact us via Support with your swap ID and a refund address on the correct network. A refund is paid only for coins we actually received and confirmed. Deposits worth less than a few dollars (our published dust limit) cannot be returned, because the network fees of returning them would exceed the deposit; such coins are not swept and stay on the deposit address. Once we have sent a payout, the swap is complete and cannot be reversed.
7. Cryptocurrency risks
- Irreversibility. Blockchain transactions are final once broadcast.
- Volatility. Prices move quickly; with a floating rate the final amount follows the market until your deposit confirms.
- Network conditions. Confirmation times, congestion, forks, reorganisations, and the behaviour of token contracts (including third-party actions such as freezing of stablecoin addresses) are outside our control and can delay or prevent a swap.
8. Availability and changes
We may add or remove coins and pairs, change minimums, maximums, confirmation requirements, fees and payment windows, or pause the Service for maintenance, at any time. Changes apply to swaps created after the change; a swap already created keeps the terms it was quoted with. We may update these Terms by publishing a new version; continued use after that is acceptance of the new Terms.
9. Partners and API access
Aggregators and other integrators use the Service through the partner API and referral links under credentials issued by Bitania. Partners are responsible for their own users and for presenting quotes, statuses and refund options correctly. Revenue-share arrangements are agreed separately with each partner and may be changed or ended with notice.
10. No warranties
The Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, that any rate will be available, or that any swap will complete within a particular time. Nothing on the site or in the API is investment, legal or tax advice.
11. Limitation of liability
Except in cases of gross negligence or fraud, Bitania and its affiliates, officers, employees and contractors are not liable for indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Service, even if advised of the possibility of such damages. Where Bitania is liable for gross negligence in connection with a swap, our liability is capped at the lower of USD 10,000 or the fees paid to Bitania on the swap that gave rise to the claim.
12. Indemnification
You agree to indemnify Bitania against claims, losses and expenses arising from your breach of these Terms or your unlawful use of the Service.
13. Intellectual property
The Bitania name, logo, site and documentation are owned by Bitania. Partners may reference Bitania as a swap provider in their own products; any other use of our brand needs our written consent.
14. Governing law and disputes
These Terms and any dispute arising from them or from your use of the Service are governed by the laws of the Republic of Panama, without regard to its conflict-of-laws rules, and the courts of the Republic of Panama have exclusive jurisdiction. Claims must be brought individually; you waive participation in class or representative actions. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO A TRIAL BY JURY.
15. Letter of guarantee
Every swap comes with a letter of guarantee: a plain-text statement of what was agreed, signed with Bitania's PGP key at each step of the swap (swap created, deposit confirmed, payout sent, refund sent). Each letter records the pair, the order type and fee, the rate, the amounts, our deposit address and the payout address you gave, and the transaction ids once they exist. The letters are shown on your swap page and can be saved as a text file.
Our public key is published at /pgp.txt (fingerprint D70F 87D6 61E3 42A9 F4CD 50BB 1809 6029 551B E178). Any OpenPGP tool can check a letter against it (gpg --verify). A letter that verifies against that key was issued by us and we stand by its content; a document that does not verify against it, whatever it looks like or claims, was not issued by Bitania and binds us to nothing. The letter records the terms of a swap; it does not remove the risks described in section 7.
